Wedding Flowers - Terms and Conditions
These terms and conditions are those which Scents2U (“we”/”us”)
makes this website available to you and on which we provide
our goods and services.
This legal notice applies to the entire
website and any correspondence between Scents2U and yourself
(“the
customer”). Please read these terms and conditions
carefully. By using this website you accept these terms and
conditions whether or not you wish to place an order.
The
Seller
This site is operated by Scents2U of 28 Sywell Road,
Overstone, Northampton, NN6 0AN. If you have any questions
with regard
to these terms and conditions or have any comments or complaints
please contact us via email or by contacting 01604 230533.
Orders
All orders received will be delivered the next working
day or on a date specified. Orders received on Saturday and
Sunday
will be delivered locally (Northamptonshire) on Monday or
nationally on the Tuesday. Orders received on a Bank Holiday
will be processed the next working day and will be delivered
locally (Northamptonshire) on the day after the bank holiday
or nationally on the second day after the bank holiday.
Flower
Availability
In the event that any flower within the chosen
bouquet is unavailable we reserve the right to substitute
the unavailable
flower within the bouquet for a suitable alternative of similar
style and quality at the discretion of the florist in keeping
with the overall bouquet design. Flowers may be delivered
in bud to ensure longevity. Some flowers and plants are harmful
if eaten. Flower orders outside of our local area will be
delivered by courier within one of our specially designed
flower boxes.
Personal Messages
Any messages requested by you on a card
or sent by us on your behalf to a third party must not contain
anything which
may be considered threatening, vulgar, obscene, defamatory,
racist or which may cause embarrassment or distress to any
person or are otherwise unlawful or objectionable. You are
completely responsible for any message sent by us on your
behalf and Scents2U accepts no responsibility for message
contact. Scents reserves the right to pre screen messages
and refuse to send any objectionable message without liability
to you.
Delivery
Standard Delivery
Delivery is charged at a standard rate of £4.99
and will be added to your order as part of the checkout process.
Deliveries within the Northamptonshire area are delivered
by our driver. Deliveries outside the Northamptonshire area
will be sent via courier in our specially designed flower
boxes.
You must provide us with full delivery details which
must include the recipients name, full address, post code
and
telephone number.
In the event that the recipient is not in
when delivery is attempted we will:
* leave the order in a
secure place at the property and leave a card at the delivery
address to advise
* leave the order with a neighbour (unless there is a specific
request NOT to do so) and leave a card at the delivery address
to advise
* if either of the above is not viable we will leave a card
at the delivery address to advise of attempted delivery and
request contact to arrange re-delivery
In the event of a wrong or incomplete address provided by
the customer which results in non-delivery Scents2U will
not be liable.
It is the responsibility of the customer to ensure that
the recipient will be present at the delivery address provided
and not absent for reasons such as holiday. In the event
of non-delivery caused by this event Scents2U will not be
liable.
Delivering to business addresses
For deliveries to business
addresses we must have the additional information provided
as detailed:
* Department recipient works in
* Extension telephone number
For deliveries to larger organisations these are normally
left at reception. This being the case Scents2U are not responsible
if the order does not reach the recipient.
Deliveries to Hospitals
As some hospitals do not allow flowers on the wards it is
the customers responsibility to check beforehand whether
the ward allows flowers. By placing an order you will have
checked this and Scents accept no responsibility in the event
that the ward does not accept delivery.
Cancellations
Cancellations must be received at least 24
hours prior to despatch to be entitled to a full refund.
Cancellations received
on Sunday or Bank Holiday Monday will be treated as received
the next working day. To cancel or amend an order please
contact us.
Force Majeure
We shall not be liable for any failure to perform
where such failure or delay is due to circumstances outside
of
our reasonable control, including, but not limited to, flood,
fire, explosion, accident, adverse weather, traffic conditions,
vehicle breakdown, obstruction of public highway, riot, war,
act of God or from any industrial dispute whatsoever.
Warranties
and Disclaimers
Whilst we agree to use reasonable endeavours
to ensure that the Scents2U website and the services provided
are fully
operational and error free we cannot accept responsibility
for any defects or interruption to services and shall be
released from these terms and conditions in the event of
any situation beyond our reasonable control.
Our liability in contract, tort or otherwise in our contract
with you shall not exceed a multiple of one times the price
of goods and services paid for. We exclude all liability
for any claims, losses, demands or damages, including without
limitation, any costs, loss of profits, loss of contracts
or business opportunity, loss of data and any other consequential,
incidential or special or punitive damages, even if we have
been advised of the possibility of such damages, arising
directly or indirectly from your inability to access the
Scents2U website and/or its goods and services, whether arising
in contract, tort, statute or otherwise, provided that nothing
in these terms and conditions affects your statutory rights
in relation to the quality, fitness or description of the
goods and services provided.
General
Scents2U has taken reasonable care in the production
of this website. However, packaging and products may vary
from
that shown, as may the colour and appearance of our flowers.
Any typographical error or omission on the website or in
any document or information issued by us shall be subject
to correction without any liability on our part.
We will make every effort to deliver your order as requested,
but will not be liable if we fail due to circumstances beyond
our control. If we are unable to deliver your order we will
notify you, except that we reserve the right to substitute
goods and packaging of equal or higher value (at no extra
cost) in the event of supply difficulties.
These terms and conditions are subject to change from time
to time. Such changes will be posted on this website and
it is your responsibility to ensure that you are aware of
the current terms and conditions when you use this website.
Changes made will become effective immediately.
We will comply with the provisions of the Data Protection
Act 1988 using third party data only for the purposes of
fulfilling our order obligations under these terms and conditions.
You are prohibited from posting to this website any material
which is, without limitation, defamatory, illegal, obscene
or technically harmful. You are also prohibited from sending
unsolicited advertising commonly referred to as spam.
You will indemnify Scents2U from any loss or damage caused
as a result of your beach of the above obligations.
Complaints
In the rare instance that you are unhappy with
the ordered design please contact us within 24 hours of delivery
with
your reasons for complaint.
